Catchy Terms of Use

These Terms of Use ("Terms") are an agreement between you and Mobixify LTD ("Mobixify", "we", "us"), a company registered in England and Wales with company number 16138122 and its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. They govern your use of Catchy (the "game") and of the online services that go with it, including the game server and the account website (together, the "service"). By downloading, installing or using the game, or by creating an account, you accept these Terms. If you do not accept them, do not use the game.

Apple's Standard EULA

If you get the game from the Apple App Store, Apple's Standard End User License Agreement (the "Standard EULA") also applies to you. These Terms add to the Standard EULA. If they conflict on a matter that the Standard EULA covers, the Standard EULA prevails. Apple is not a party to these Terms: Mobixify, not Apple, is responsible for the game, its support and any claims about it.

Who can play

You must be at least 13 years old to create an account or play the game, or older if the law where you live requires a parent's or guardian's permission for you to use an online service. If you are under 18, make sure a parent or guardian is happy for you to play. The game shows cartoon fantasy violence between characters and lets you chat with people you do not know. We do not knowingly allow children under 13 to use the service, and we delete accounts that we find belong to them.

Your account

• You need an account to play. You must give us a working e-mail address and may choose a display name. Keep your details accurate. When you create an account, the game shows a line with links to these Terms and the Privacy Policy, the zero-tolerance rule below and the minimum age of 13.
• One person, one account. Do not share your account, sell it or transfer it. An account can be in the game on one device at a time: signing in on a second device disconnects the first.
• Keep your password secret. You are responsible for what happens under your account. Tell us at once at info@mobixify.com if you think someone else is using it.
• Your display name and the names of the rooms you create must follow the Community rules below.
• You can delete your account at any time, as described under Deleting your account.

Licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices that you own or control, for your own non-commercial use, in line with these Terms and the terms of the store you got it from. You may not copy, modify, sell, rent or distribute the game, reverse engineer it except where the law allows, remove notices from it, or interfere with the service. We and our licensors keep all rights in the game, including its characters, artwork, music and code, that these Terms do not give to you.

Community rules

We want Catchy to be fun for everyone. We have zero tolerance for objectionable content and for abusive users. These rules apply everywhere in the service: chat, display names, room names, and how you behave in a match.

You must not:

• harass, bully, threaten, stalk or abuse anyone, or encourage others to do so;
• use hate speech or discriminate against people because of their race, ethnicity, nationality, religion, sex, gender, sexual orientation, age, disability or any other protected characteristic;
• post or write sexual or pornographic content, or anything that sexualises children. We report content that exploits or endangers children to the authorities;
• post content that is violent, shocking or gratuitously offensive, or that promotes terrorism, self-harm, suicide, eating disorders, illegal drugs or other crime;
• share other people's personal information, or ask a child for personal information, contact details or to move to another app;
• pretend to be someone else, including our staff;
• send spam, advertising, scams or links to harmful sites;
• use a name, room name or message that breaks these rules, including in disguised form such as spacing, symbols or misspellings;
• cheat, exploit bugs, use bots, scripts or modified clients, boost or sell accounts, or disrupt matches on purpose, for example by quitting or standing still to spoil a match for your team;
• try to get around the service's limits or security, to attack the servers, or to avoid a ban, for example by creating a new account;
• misuse the report tool, for example by reporting people falsely; or
• break the law or the rights of anyone else.

Hooking, pulling and biting other characters in a match is the game and is allowed. Abuse of the people behind the characters is not.

Reporting and blocking

Every signed-in player can report and block others from the room screen.

• Report. Tap REPORT on another player's slot in the room, choose a reason (abusive chat, offensive name, spam, cheating or other) and send the report. If a player insults you and then leaves, you can still report them from the same window while you are in the room. The server copies the last chat lines that player wrote in that room and that you could read, so you do not have to send screenshots. The player is never told who reported them. You can send up to 20 reports a day.
• Block. Choose BLOCK in the same window. Blocking hides that player's chat lines from you on your device. It does not remove them from the room or the match. You can choose UNBLOCK in the same window while the player is in your room.
• Room hosts. The host of a room can kick or ban players from that room. A host has no other authority.
• Other ways to tell us. You can also write to info@mobixify.com, or use the support page at https://appstore.mobixify.com/games/catchy/support/, about a player, a room or any content, including content that you think is illegal. Please give the display name, the room name and the time.

Our own team reviews reports and acts on reports of objectionable content within 24 hours. We may not tell you what action we took.

Moderation and bans

The game filters offensive words in chat, names and room names on your screen. The filter is not perfect, and we do not read or approve what players write before it appears. Our own team reviews reports, and we may check account data and logs to deal with them.

If you break these rules, or we reasonably think you have, we may, without warning and at our discretion:

• remove or change a display name or room name, or require you to change it;
• warn you, restrict what you can do in the service, or remove you from a room or a match;
• suspend your account or ban it permanently; and
• tell the authorities where we think a crime has been committed, or where the law requires us to.

Because we have zero tolerance, serious or repeated breaches lead to a permanent ban, and a first breach can too. If we ban your account, you may not create another to avoid the ban. If you think we made a mistake, write to info@mobixify.com from the e-mail address of the account, within 30 days, and tell us what happened. We will look at it again and reply, normally within 14 days.

Your content

Your display name, room names and chat messages are your content. You are responsible for it. You give us a non-exclusive, worldwide, royalty-free licence to host it, copy it and show it to other players, and to use it to run, moderate and protect the service. This licence ends when your content is deleted from the service, except for copies we need to keep as described in the Privacy Policy. What other players write is theirs. We do not endorse it and are not responsible for it, but we will act on it as described above.

Virtual items and gold

Gold and items in the game are earned by playing and exist inside a match only. They have no cash value, cannot be bought, sold or exchanged for money, and are not your property. The game has no real-money purchases. If we add any, we will change these Terms first, and the store's rules for purchases will apply.

The online service and changes

The game works only with the online service. We provide the service as it is available from time to time. It may change: we may add, change, limit or remove features, rooms, modes, heroes, items, ratings or statistics. We may require you to install the latest version of the game, and an older version may stop working. We may take the service down for maintenance, and it may be interrupted by problems we do not control. We may also end the service or the game, in whole or in part. Where we reasonably can, we will give notice in the game or on the store listing. If we end the service, the game may no longer work, and we will delete the accounts and personal data held for it, as the Privacy Policy describes.

Deleting your account

You can delete your account yourself, in the game (open Profile and choose DELETE ACCOUNT), on the account website at moba.ping999.tr/account/delete, or by writing to info@mobixify.com from the e-mail address of your account. Deleting an account is permanent and ends your access to the service. Your name and ID are removed from finished match records. The Privacy Policy at https://appstore.mobixify.com/games/catchy/privacy/ explains what is deleted and what is kept, and for how long.

Privacy

How we handle your personal data is described in the Privacy Policy at https://appstore.mobixify.com/games/catchy/privacy/. The game links to the Privacy Policy, these Terms and the support page in its Settings and on the sign-in screen.

Safe play

Play in a safe place and take regular breaks. Do not use the game while driving or in any situation where you need your attention elsewhere. Internet or mobile data charges from your provider may apply.

Warranty and liability

The game and the service are provided "as is". To the extent the law allows, we give no warranty that they will be uninterrupted or error free, and we are not liable for indirect or consequential loss or for loss of data such as your account, statistics or match history. We are not responsible for what other players write or do. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects the rights you have as a consumer, including that digital content must be of satisfactory quality, fit for purpose and as described. Subject to this, our total liability to you for all claims about the game and the service is limited to the amount you paid for them in the 12 months before the claim.

Ending these Terms

You can stop using the game at any time by deleting your account and the game. We can end your licence and your access to the service if you break these Terms. Sections that by their nature should continue to apply will do so after the Terms end.

Governing law

These Terms and any dispute about them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless the law of the country where you live gives you the right to bring a claim in your local courts or to rely on its mandatory consumer rules.

Changes to these Terms

We may update these Terms. The new version applies from the effective date shown on this page, and your continued use of the game means you accept it. We will say so in the release notes on the store or in the game when a change matters to you.
