Gloomrush Terms of Use

These Terms of Use ("Terms") are an agreement between you and Mobixify LTD ("Mobixify", "we", "us"), a company registered in England and Wales with company number 16138122 and its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. They govern your use of Gloomrush (the "game"). By downloading, installing or using the game you accept these Terms. If you do not accept them, do not use the game.

Apple's Standard EULA

If you get the game from the Apple App Store, Apple's Standard End User License Agreement (the "Standard EULA") also applies to you. These Terms add to the Standard EULA. If they conflict on a matter that the Standard EULA covers, the Standard EULA prevails. Apple is not a party to these Terms: Mobixify, not Apple, is responsible for the game, its support and any claims about it.

Licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices that you own or control, for your own non-commercial use, in line with these Terms and the terms of the store you got it from. You may not copy, modify, sell, rent or distribute the game, reverse engineer it except where the law allows, remove notices from it, or use cheats, tools or modified versions to change how it works. We and our licensors keep all rights in the game, including its characters, artwork, music and code, that these Terms do not give to you.

Who can play

The game is meant for players aged 13 and over. If you are under 18, make sure a parent or guardian is happy for you to play. The game contains fantasy violence against monsters and may show flashing effects. You can turn flashes, screen shake and damage numbers off in the settings. If you have a condition such as photosensitive epilepsy, check with a doctor before you play.

Offline play, no account

The game works offline and has no account, no sign-in, no advertising and no in-app purchases. Everything in the game, including its gold, upgrades, heroes and stages, is earned by playing. Gold and upgrades are part of the game only: they have no cash value and cannot be bought, sold or exchanged for money.

Your progress and settings

Your progress and settings are saved on your device only. We do not keep a copy and we cannot restore them. If you delete the game, clear its storage or lose your device, your progress is lost, unless your own device backup restores it. The Privacy Policy explains what the game stores and what it does not.

Updates and changes

We may update the game, fix problems, and add, change or remove features, levels or content. An update may be needed to keep the game working on newer devices. The game needs a device and operating system version that meet the requirements shown in the store.

Safe use

Play in a safe place and take regular breaks. Do not use the game while driving or in any situation where you need your attention elsewhere.

Third-party components

The game contains components from third parties, which are used under their own licences. Nothing in these Terms limits your rights under those licences.

Warranty and liability

The game is provided "as is". To the extent the law allows, we give no warranty that it will be uninterrupted or error free, and we are not liable for indirect or consequential loss or for loss of data such as game progress. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects the rights you have as a consumer, including that digital content must be of satisfactory quality, fit for purpose and as described. Subject to this, our total liability to you for all claims about the game is limited to the amount you paid for it in the 12 months before the claim.

Ending these Terms

You can stop using the game at any time by deleting it. We can end your licence if you break these Terms. Sections that by their nature should continue to apply will do so after the Terms end.

Governing law

These Terms and any dispute about them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless the law of the country where you live gives you the right to bring a claim in your local courts or to rely on its mandatory consumer rules.

Changes to these Terms

We may update these Terms. The new version applies from the effective date shown on this page, and your continued use of the game means you accept it. We will say so in the release notes on the store when a change matters to you.
